    <title>"Cease and Desist"?</title>

    <summary type="html">&lt;div&gt;So this isn't exactly the perfect fit for this tribe, but it may be possible that as moderators you have come across this. I'd replied to a thread [not in a tribe I moderate] with a benign quick bio that seemed to run along the theme of other bio's posted by the author, and the thread was deleted then reposted without my reply. I then asked in thread 'oops what happened to the last thread' and got this out of the blue:

&lt;br/&gt;"please cease and desist from further contact with me, including replies to my posts. your behavior constitutes harassment.. every post you make is a fight against me...or against the various Buddhist monks who come on here 
&lt;br/&gt;
&lt;br/&gt;you are not a Buddhist 
&lt;br/&gt;
&lt;br/&gt;you are some kind of right wing troll here to harass Buddhism. your behavior is not only some kind of violation of courtesy, it actually constitutes criminal behavior, since you have a malicious intent to harass me... 
&lt;br/&gt;
&lt;br/&gt;if you continue to annoy me, I will contact Tribe Net...if you go farther, I will prosecute you in a court of law does that explain why I deleted your post? I hope so and I hope someone with the time, finds time to prosecute you and put you and the other trolls in prison, where you clearly belong "
&lt;br/&gt;
&lt;br/&gt;Honestly if you had seen the history of my posts, you wouldn't think that I had in any way harrassed this man. At worst, I may have disagreed with others with regard to their insistance on the 'true Buddhist Way' [I -am- Buddhist FWIW] but never have we come to argument in public or private.

&lt;br/&gt;Clearly I am not intimidated by the prosecution threat, but the Tribe evidence [for a TOU investigation] has been deleted, so who is to say? Do they back these things up? As moderators, have you come across this?

    <title>A bug in changing moderators</title>

    <summary type="html">&lt;div&gt;If any of you are about to appoint another person to be moderator of the tribe you moderate be prepared for a malfunction. If you do try it, leave settings such as members can invite other people on, in case it doesn't work.
&lt;br/&gt;
&lt;br/&gt;It seems there is a bug in the system when one tries to appoint a new moderater the last couple of days. Yesterday I read that someone had a similar situation to what I today have experienced. It may be happening to private tribes only, but I have a feeling it is happening with all tribes, based on the situation I read in the tribe Shamanism (which I'm not in but was reading out of concern with how the outgoing mod was being treated by the rest of the tribe.)
&lt;br/&gt;
&lt;br/&gt;In Shamanism, a public tribe, the moderator wanted to appoint a new mod, and I'm thinking she did indeed do that rather than just leave without appointing anyone, which is what I thought happened when I looked at it yesterday.
&lt;br/&gt;
&lt;br/&gt;In my case, I was just appointed moderator of a private tribe, a temporary position while the mod went away for a little while and wouldn't be checking the internet. We thought this was a wise move. Many of you in this tribe can probably relate, as we are wishing that SFSlim had appointed another moderator during the time of his absence.
&lt;br/&gt;
&lt;br/&gt;So in the private tribe I'm in the moderator attempted to appoint me as moderator while she was away. I received a PM saying that I am now the moderator, but in fact I have no moderator controls for the private tribe, and the mod spot says "choose a new moderator".
&lt;br/&gt;
&lt;br/&gt;Moderators, this is my alert. Don't change mods right now, until this bug has been fixed, or your tribe will be left unmoderated. And I don't know how long it can take to get a mod put back in place once this has happened.
&lt;br/&gt;
&lt;br/&gt;If you are still tempted to appoint a new moderator and the tribe is moderated or private, make sure you at least have the settings set so that members can invite others. That way the tribe can be accessible through the current members, in case it takes a long time to fix this bug.&lt;/div&gt;

&lt;br/&gt;Not unsubscribed users, but users who haven't logged on in over a year or some such metric.
&lt;br/&gt;
&lt;br/&gt;As near as I can see there is no way of getting that information from a person's profile.  Am I missing it?

    <title>Rules... Beyond TOU... in a Tribe Far Far Away...</title>

    <summary type="html">&lt;div&gt;Recent discussions on issues like TOU and evangelical Christian posts makes me think of this ..
&lt;br/&gt;
&lt;br/&gt;The TOU don't cover everything and can be ambiguously interpreted. Moderators who arbitrarily enforce unclear TOU and unclear  rules can become the victim of vitriolic attack. 
&lt;br/&gt;
&lt;br/&gt;To overcome this, what is to stop a moderator running a thread within a tribe where "rules" and perhaps "purpose" are discussed and agreed upon? 
&lt;br/&gt;
&lt;br/&gt;This would empower moderators with terms of reference when addressing issues during conflict and problem times.. TOU are all very well - but democratically establishing some rules to cricket seems a great idea. (Especially when a tribe's subject is a contentious issue(s) likely to see open conflict)...  I have seen such things assist moderators resolve conflict and address the behaviour of rogue members in the past.. 
&lt;br/&gt;
&lt;br/&gt;I have only done that in one tribe I moderate. That is a tribe where people discuss stuff which is very personal and confidential. The rules are designed to protect that confidentiality, make people comfortable with posting information, and also establishing rules on who, and how, members are admitted...  We have nine agreed rules (sorry but I cant post them here..) and these were established within the first few weeks of the tribes existence.. People who want to become members must be supplied the rules and agree to them prior to joining this private tribe..

&lt;br/&gt;Have other mods posted threads where rules of conduct and content are discussed and agreed upon ?

&lt;br/&gt;I recently got booted from the Movie Quotes Tribe after protesting that the moderator deleting content (that did not violate TOU in MHO). That’s how I found this tribe looking for advice and answers about that situation..

&lt;br/&gt;I decided just to get over being kicked out and forget it. 
&lt;br/&gt;

&lt;br/&gt;In this tribe you can post info. about your tribes...perhaps provide links to your most interesting threads in your past topical archives

&lt;br/&gt;also ask others to make deals to invite 3 or more of thier friends to your tribe....... 
&lt;br/&gt;(certain friends that they feel would be intested in that tribe) 
&lt;br/&gt;And you would agree also to do the same for their tribe 
&lt;br/&gt;
&lt;br/&gt;So in that thread titled after the name of your tribe...others will sign on to deals with you to boost each others tribe\tribes with 3 or more invites of close friends 
&lt;br/&gt;
&lt;br/&gt;Of course to do this you both must join each others tribes to activate the invite friends to tribe option 
&lt;br/&gt;ALSO PROVIDE IN THAT THREAD LINKS TO YOUR TRIBE

&lt;br/&gt;responders will intern join your tribe and post links to their tribe...and contact you both in your thread and personally to ensure a quick response and to make sure both parties are interested in endorsing each others tribe idea

&lt;br/&gt;What do folks think about being able to check a "ban user" checkbox when booting a member from a Tribe?  This might be something relatively easy to implement on the banning side, but it would probably take a while to whip up the UI to un-ban someone.

&lt;br/&gt;Since trolls tend to go out of their way to join Tribes as new members anyway, is this really all that much of a step up above flipping the Tribe to moderated until things calm down?&lt;/div&gt;

    <summary type="html">&lt;div&gt;When a change occurs in a tribe's needs or focus and a long-standing silent member returns with a different  need or understanding yikes!! all holy  heck  can break loose.
&lt;br/&gt;
&lt;br/&gt;I and the tribe members hae definitely been experiencing this. I wish it weren't so. 
&lt;br/&gt;I am tempted to bad mouth the trib eand such but not going to do so. I am feelign that the change in need of the tribe members is now narrow and limiting, but whiel I may say that it doesn't legitimize their desires or need. It also makes me the 'bad' poster, jostling with words and posts and  discussions, supposedly sayign wrong things in too  many different ways.
&lt;br/&gt;
&lt;br/&gt;i hesitate to leave the tribe, things may change in a few months.. definitely not weeks, as it is a group of people whose binding theme in that tribe is one which doesn't seem to encourage growth or change.
&lt;br/&gt;Maybe, maybe not. Suffice to say, i have gone through enough feelings and emotions about it and shall post rarely if ever anymore.  It is a waste of time to 'justify' my style or needs in wake of many negative interactions.&lt;/div&gt;

As best I can tell, right now you have to delete one post at a time.  It might be nice if every post had a check box and the moderator could go through and check the ones that should be deleted and multiple posts could be deleted at the same time.  Or is there a way to delete multiple posts and I am just not aware of it?&lt;/div&gt;

&lt;br/&gt;I'm seeing this &amp;amp; related topics all over moderators &amp;amp; tribe ideas, so I'm cross posting this:
&lt;br/&gt;
&lt;br/&gt;When existing tribes realize they are redundant, what should the goal be?
&lt;br/&gt;
&lt;br/&gt;To create a single big tribe with multiple co-moderators/co-creators? 
&lt;br/&gt;to create one tribe with only one moderator?  
&lt;br/&gt;(another thread mentions possible creator/moderator separation, multiple moderators. I like both ideas)
&lt;br/&gt;
&lt;br/&gt;[and heres another function: cross-linking threads that a post spans!]
&lt;br/&gt;
&lt;br/&gt;to leave the tribes separate but link them so that membership in one automatically generates membership in the others? 
&lt;br/&gt;automatic (or optional) cross-posting?  
&lt;br/&gt;
&lt;br/&gt;this  would allow the creation of  meta-tribes, families of tribes that deal with related but still somewhat distnct topics - I guess the function could be pretty much like individuals making friends - one moderator sees a related tribe, sends an invite to the other moderator offering to create a meta-tribe. if the second one clicks "agree", then the system creates a new meta-tribe. could be very cool!  
&lt;br/&gt;
&lt;br/&gt;then theres all the same questions about creator/moderator issues (who has control of whether a new tribe gets accepted into a meta-tribe, etc)  
&lt;br/&gt;
&lt;br/&gt;then also would come the inevitable question of: could one tribe be a member of two different meta-tribes?
&lt;br/&gt;
&lt;br/&gt;
&lt;br/&gt;I'm not sure if idea of sub-tribes is more or less synonymous with meta-tribes, or close enough..
&lt;br/&gt; Do we need one functon? or two? or three?
&lt;br/&gt;
&lt;br/&gt;my vote is to allow both tribe-merger and meta-tribes. &lt;/div&gt;

    <summary type="html">&lt;div&gt; The intent of this thread is just to be a check-in on what, if anything is getting deleted by TOU at tribe today.
&lt;br/&gt;As many here are also, I recently returned to what appears to be a better tribe than what was melting down earlier this year.
&lt;br/&gt;The tribes I'm still on that deal with deletions and TOU censorship are mellow with inactivity.
&lt;br/&gt;I was able to find a rather naughty sex tribe just by clicking through the standard "sidewalk traffic."
&lt;br/&gt;No tribes I'm on have reported any deletions, and I'm in some wild tribes.
&lt;br/&gt;I did talk with a friend who had some naughty photos knocked from public to private view by unseen hands,
&lt;br/&gt;but no deletion.
&lt;br/&gt;How are other people experiencing this?
&lt;br/&gt;
&lt;br/&gt;I hope to keep this thread to just the facts,
&lt;br/&gt;no pro and con about TOU or Freedom of expression.&lt;/div&gt;

&lt;br/&gt;Despite reports to the contrary, a purchase of social networking site Tribe.net by NBC Universal is not a done deal. According to a source inside NBC Universal, the company is looking at Tribe's back-end technology for possible integration with its digital properties, which include iVillage, MSNBC.com, and Telemundo.com.
&lt;br/&gt;
&lt;br/&gt;NBC Universal had no comment regarding the reports.
&lt;br/&gt;
&lt;br/&gt;According to the source, NBC also is evaluating other social networking site technologies. The company has signed a letter of intent to conduct due diligence of Tribe's technology; however, the source stressed, "To say we're buying it, that's not true." As for the cost of acquiring Tribe.net as a whole or its technology only, the source said it would be "well under $5 million."
&lt;br/&gt;
&lt;br/&gt;In a continuing effort to scoop up ad dollars that are moving away from television properties towards the Web, NBC is clearly evaluating ways of harnessing the traffic-driving popularity of social networking for its own sites. NBC.com and iVillage both already feature message boards and blogs.
&lt;br/&gt;
&lt;br/&gt;A social networking integration could also prove interesting for NBC Universal's Spanish language site Telemundo.com, which merged with the Yahoo en Espanol site earlier this year.
&lt;br/&gt;
&lt;br/&gt;In addition, Tribe.net's classifieds listings capabilities could be used to enhance NBC's local broadcast affiliate sites.

&lt;br/&gt;Shatter and Mystic have repeatedly broken key tribe rules, see Tribe's Terms Of Use and Code Of Conduct. . They did "inflame", "intimidate", "libel" and "defame", several members of Tribe. Both of them also repeatedly posted photographic material that was unauthorized, and published with the intent to defame certain Tribe members. Shatter also had his Flick'r/YAHOO account terminated about 2 weeks ago, after using the same unauthorized photos. 
&lt;br/&gt;
&lt;br/&gt;Shatter and Mystic played a key role in the hijacking of my tribe - SF The Citadel Tribe (as described and discussed in 3 treads here: "The Rights Of A Moderator", "What We Have Learned About Tribe" and "Open Letter To The Tribe.net Administration"). Mystic has described the take-over as a "succesful non-violent coup".

&lt;br/&gt;Shatter has supposedly returned to Tribe after being deleted, using an alternative identity - and posting things in the Bondage A Go Go Tribe. &lt;/div&gt;

    <summary type="html">&lt;div&gt;Many of my friends have moved over to MySpace.com, and I'm disturbed by it.  First, the place is so ghetto, and it seems to attract mostly 14 year old girls.

&lt;br/&gt;Tribe, for all its faults has class.  There are intelligent discussions here and no annoyance from music blasting when I click on someone's profile.  Tribe is good, but jeez, you guys are alienating so many people!  There won't be anybody left if you keep this up.

&lt;br/&gt;I 86'd a member after a lengthy problem with his aggressive posting style that caused many of the other members to complain. When I dumped this guy I pretty much got a standing ovation from the other members.

They have no friends, no real profile and you can tell they advertize because the same thing is located in the profile under recent activity.  Who else has seen this?

    <summary type="html">&lt;div&gt;I tried the back-step trick that usually works if you want to edit a post after you have hit "submit," but used it on a response to a blog posting.  I got this message after hitting the back button, editing, then hitting the "submit" button:

    <title>TOU guy is really, truly an idiot</title>

    <summary type="html">&lt;div&gt;I don't buy any of the crap i hear on here from any of the Tribe representatives about how the flagging works. 
&lt;br/&gt;
&lt;br/&gt;In the last day, and this has happened before, some thirty-odd pics have been removed from the gallery in the *sex talk* tribe i manage. Primarily they are drawings or paintings - DRAWINGS and PAINTINGS, not photos - of sexual situations. That isn't so bad, but there are a number of comic stories - a series of 12 to 15 images in a row that tell a situational short story of a sexual nature, mostly not graphic at all - where the TOU guy has chosen to remove one single frame in the middle of the series, thus ruining the whole thing. It appears completely indiscriminate. Since yesterday four seperate stories have been spoiled. If there is something TOU guy finds offensive in a story he should remove the whole thing, and not just one page of the comic in the middle. 
&lt;br/&gt;
&lt;br/&gt;There is no way that members of the tribe are choosing these random frames to flag. And i have never, EVER received a response to my queries about the many random, and unwarranted, removals that have occurred since these uptight changes have gone into place in this new paranoid Tribe.  TOU guy is a prudish, shiftless, arbitrary, insensate, stupid idiot.

&lt;br/&gt; I don't believe any of the platitudes i hear from Tribe on this issue and i'm done with politeness. It's terrible what has happened to Tribe.   &lt;/div&gt;

    <title>California Civil Code Section 3344 (Unauthorized use of Likeness)</title>

&lt;br/&gt;3344.  (a) Any person who knowingly uses another's
&lt;br/&gt;name, voice,
&lt;br/&gt;signature, photograph, or likeness, in any manner, on
&lt;br/&gt;or in products,
&lt;br/&gt;merchandise, or goods, or for purposes of advertising
&lt;br/&gt;or selling, or
&lt;br/&gt;soliciting purchases of, products, merchandise, goods
&lt;br/&gt;or services,
&lt;br/&gt;without such person's prior consent, or, in the case
&lt;br/&gt;of a minor, the
&lt;br/&gt;prior consent of his parent or legal guardian, shall
&lt;br/&gt;be liable for
&lt;br/&gt;any damages sustained by the person or persons injured
&lt;br/&gt;as a result
&lt;br/&gt;thereof.  In addition, in any action brought under
&lt;br/&gt;this section, the
&lt;br/&gt;person who violated the section shall be liable to the
&lt;br/&gt;injured party
&lt;br/&gt;or parties in an amount equal to the greater of seven
&lt;br/&gt;hundred fifty
&lt;br/&gt;dollars ($750) or the actual damages suffered by him
&lt;br/&gt;or her as a
&lt;br/&gt;result of the unauthorized use, and any profits from
&lt;br/&gt;the unauthorized
&lt;br/&gt;use that are attributable to the use and are not taken
&lt;br/&gt;into account
&lt;br/&gt;in computing the actual damages.  In establishing such
&lt;br/&gt;profits, the
&lt;br/&gt;injured party or parties are required to present proof
&lt;br/&gt;only of the
&lt;br/&gt;gross revenue attributable to such use, and the person
&lt;br/&gt;who violated
&lt;br/&gt;this section is required to prove his or her
&lt;br/&gt;deductible expenses.
&lt;br/&gt;Punitive damages may also be awarded to the injured
&lt;br/&gt;party or parties.
&lt;br/&gt;  The prevailing party in any action under this
&lt;br/&gt;section shall also be
&lt;br/&gt;entitled to attorney's fees and costs.
&lt;br/&gt;   (b) As used in this section, "photograph" means any
&lt;br/&gt;photograph or
&lt;br/&gt;photographic reproduction, still or moving, or any
&lt;br/&gt;videotape or live
&lt;br/&gt;television transmission, of any person, such that the
&lt;br/&gt;person is
&lt;br/&gt;readily identifiable.
&lt;br/&gt;   (1) A person shall be deemed to be readily
&lt;br/&gt;identifiable from a
&lt;br/&gt;photograph when one who views the photograph with the
&lt;br/&gt;naked eye can
&lt;br/&gt;reasonably determine that the person depicted in the
&lt;br/&gt;photograph is
&lt;br/&gt;the same person who is complaining of its unauthorized
&lt;br/&gt;use.
&lt;br/&gt;   (2) If the photograph includes more than one person
&lt;br/&gt;so
&lt;br/&gt;identifiable, then the person or persons complaining
&lt;br/&gt;of the use shall
&lt;br/&gt;be represented as individuals rather than solely as
&lt;br/&gt;members of a
&lt;br/&gt;definable group represented in the photograph.  A
&lt;br/&gt;definable group
&lt;br/&gt;includes, but is not limited to, the following
&lt;br/&gt;examples:  a crowd at
&lt;br/&gt;any sporting event, a crowd in any street or public
&lt;br/&gt;building, the
&lt;br/&gt;audience at any theatrical or stage production, a glee
&lt;br/&gt;club, or a
&lt;br/&gt;baseball team.
&lt;br/&gt;   (3) A person or persons shall be considered to be
&lt;br/&gt;represented as
&lt;br/&gt;members of a  definable group if they are represented
&lt;br/&gt;in the
&lt;br/&gt;photograph solely as a result of being present at the
&lt;br/&gt;time the
&lt;br/&gt;photograph was taken and have not been singled out as
&lt;br/&gt;individuals in
&lt;br/&gt;any manner.
&lt;br/&gt;   (c) Where a photograph or likeness of an employee
&lt;br/&gt;of the person
&lt;br/&gt;using the photograph or likeness appearing in the
&lt;br/&gt;advertisement or
&lt;br/&gt;other publication prepared by or in behalf of the user
&lt;br/&gt;is only
&lt;br/&gt;incidental, and not essential, to the purpose of the
&lt;br/&gt;publication in
&lt;br/&gt;which it appears, there shall arise a rebuttable
&lt;br/&gt;presumption
&lt;br/&gt;affecting the burden of producing evidence that the
&lt;br/&gt;failure to obtain
&lt;br/&gt;the consent of the employee was not a knowing use of
&lt;br/&gt;the employee's
&lt;br/&gt;photograph or likeness.
&lt;br/&gt;   (d) For purposes of this section, a use of a name,
&lt;br/&gt;voice,
&lt;br/&gt;signature, photograph, or likeness in connection with
&lt;br/&gt;any news,
&lt;br/&gt;public affairs, or sports broadcast or account, or any
&lt;br/&gt;political
&lt;br/&gt;campaign, shall not constitute a use for which consent
&lt;br/&gt;is required
&lt;br/&gt;under subdivision (a).
&lt;br/&gt;   (e) The use of a name, voice, signature,
&lt;br/&gt;photograph, or likeness
&lt;br/&gt;in a commercial medium shall not constitute a use for
&lt;br/&gt;which consent
&lt;br/&gt;is required under subdivision (a) solely because the
&lt;br/&gt;material
&lt;br/&gt;containing such use is commercially sponsored or
&lt;br/&gt;contains paid
&lt;br/&gt;advertising.  Rather it shall be a question of fact
&lt;br/&gt;whether or not
&lt;br/&gt;the use of the person's name, voice, signature,
&lt;br/&gt;photograph, or
&lt;br/&gt;likeness was so directly connected with the commercial
&lt;br/&gt;sponsorship or
&lt;br/&gt;with the paid advertising as to constitute a use for
&lt;br/&gt;which consent
&lt;br/&gt;is required under subdivision (a).
&lt;br/&gt;   (f) Nothing in this section shall apply to the
&lt;br/&gt;owners or employees
&lt;br/&gt;of any medium used for advertising, including, but not
&lt;br/&gt;limited to,
&lt;br/&gt;newspapers, magazines, radio and television networks
&lt;br/&gt;and stations,
&lt;br/&gt;cable television systems, billboards, and transit ads,
&lt;br/&gt;by whom any
&lt;br/&gt;advertisement or solicitation in violation of this
&lt;br/&gt;section is
&lt;br/&gt;published or disseminated, unless it is established
&lt;br/&gt;that such owners
&lt;br/&gt;or employees had knowledge of the unauthorized use of
&lt;br/&gt;the person's
&lt;br/&gt;name, voice, signature, photograph, or likeness as
&lt;br/&gt;prohibited by this
&lt;br/&gt;section.
&lt;br/&gt;   (g) The remedies provided for in this section are

    <title>Sexually Explicit tribe created by Tribe?</title>

    <summary type="html">&lt;div&gt;Recently, I began cleaning up a Tribe I had created (Anal for Women) because it was in violation of Tribe's TOU (sexually explicit).  Then several days ago, I received a request from someone to take over as moderator.  Before I even had a chance to respond, this person contacted help@tribe.net, got themselves put in as moderator and got the sexually explicit content restored.  This would seem to be in direct violation of Tribe's own TOU.

&lt;br/&gt;If this Tribe is in violation of the TOU, then it should be removed.  If it is not in violation, the I wish to be restored as moderator of the tribe I created and nurtured (with a lot of time and energy).

    <title>Patti, TOU/2257 confusion.</title>

    <summary type="html">&lt;div&gt;Patti wrote "Why not make the tribe private?" in a previous thread on this forum in regard to content that had been flagged and deleted.  The content was deleted due to the fact that it was in violation of the TOU and 2257.

&lt;br/&gt;So, I'm confused.  If the new TOU is in response to 2257, then ostensibly tribe wants to remove ALL offending content.  Hiding content behind the weakest of barriers, a..."private"...tribe, will not protect tribe.net from penalties under 2257.  Yet, here Patti seems to be encouraging exactly that behavior, in violation of the TOU and Tribe's stated goal of removing offending content and protecting Tribe from legal retribution from the government.  
&lt;br/&gt;
&lt;br/&gt;There are two scenarios that I can see here.  1)  Tribe genuinely wants to remove all content, and just has a poor, easily abused system that, in reality, will not protect them from liability.  Also, Patti, against the wishes of her employer, is encouraging abuse of the weaknesses built into the system.  2)  Tribe wants to move explicit content behind closed doors, without actually removing offending content, and just suppressing it by moving it underground.

    <title>Open Letter To The Tribe.net Administration</title>

    <summary type="html">&lt;div&gt;On March 15-16, 2006, two Tribe employees took action to recover data that I, as the founder/moderator of SF The Citadel tribe, had deleted. 
&lt;br/&gt;
&lt;br/&gt;The two were: Patti Beadles, responsible for "Quality Assurance" at Tribe.net, and Jennifer Snyder, Database Administrator at Tribe.net.
&lt;br/&gt;
&lt;br/&gt;"Patti B" acted on a request from , one of the owners of The Citadel club. "Patti B" was according to her own posts assisted by "Jenni S", in her data recovery operation.
&lt;br/&gt;
&lt;br/&gt;When the work was done, "Patti B" gave my tribe to the person who requested the action in the first place, the club owner August/"Dungeon Vixen SF Citadel" - with tribe administration support.  
&lt;br/&gt;
&lt;br/&gt;I asked "Patti B": Do you deny that I had deleted the data?" 
&lt;br/&gt;
&lt;br/&gt;She replied: "I live a fact-based life; I can't deny it." 
&lt;br/&gt;
&lt;br/&gt;So, please notice here - that "Patti B" doesn't argue with the fact that I had deleted most of the data.
&lt;br/&gt;
&lt;br/&gt;This is what Tribes Terms Of Use (TOU) says: 
&lt;br/&gt;
&lt;br/&gt;"5. Content 
&lt;br/&gt;We do not claim ownership of the content you post or otherwise provide to the Service. However, you hereby grant, and agree to grant as an effect of posting or otherwise providing content, the following license: to the public, a license for personal non-commercial use; and to Tribe, a perpetual license to use, copy, distribute, display, perform, and modify any and all content that you post on the Service. This license cannot be withdrawn except that any content deleted from the Tribe site will terminate the Tribe license. Your use of the service is in consideration for this license, we will not otherwise pay you for your content. You represent and warrant that you have not granted and will not grant any rights inconsistent with this license."
&lt;br/&gt;
&lt;br/&gt;So, "any content deleted from the Tribe site will terminate the Tribe license" - Tribe.net's right to use the material in any form. 
&lt;br/&gt;
&lt;br/&gt;Some have suggested that maybe the TOU text only covers material deleted by Tribe.net - but nothing in the TOU (or FAQ) supports that. 
&lt;br/&gt;
&lt;br/&gt;It has also been suggested that maybe the TOU text means that Tribe.net's server "trash can" must have been emptied. But, again - nothing in the TOU (or FAQ) supports that - it's about data that has been deleted from the Tribe site.
&lt;br/&gt;
&lt;br/&gt;The moderator has a right to delete data, and once it is deleted the Tribe license (to use this material) is terminated. 
&lt;br/&gt;
&lt;br/&gt;This was exactly the situation here.
&lt;br/&gt;
&lt;br/&gt;"Patti B", "Jenni S", the TOU Guy and the part of the Tribe administration who gave the retroactive green light - did clearly breach Tribe's own Terms Of Use (TOU). 
&lt;br/&gt;
&lt;br/&gt;The data that was recovered and handled by Tribe staff was no longer data covered by Tribe's license.
&lt;br/&gt;
&lt;br/&gt;The Tribe license had been terminated!

    <title>What We Have Learned About Tribe</title>

    <summary type="html">&lt;div&gt;What we've learned the last couple of days is that some really basic and important guidelines &amp;amp; rules are not disclosed in the Terms Of Use (TOU) and Frequently Asked Questions (FAQ) of tribe.net.  And not just that - we've also learned that a company policy NOT outlined in writing can nullify a rule that is actually put in writing.
&lt;br/&gt;
&lt;br/&gt;Here's another lesson from the tribe I founded and moderated (SF The Citadel tribe): The more successful you are with your tribe, the larger and more active you're making it - the less influence and power you have as the founder and moderator. This has been demonstrated by the hijacking of my tribe.
&lt;br/&gt;
&lt;br/&gt;Tribe.net has sanctioned a policy that gives a green light to its staff to step in and recover deleted material, in this case a whole tribe, directly against its own written TOU.  It has given permission to an employee to give the tribe to a friend, a business woman with a financial stake in the re-opening of the tribe. This to me suggests a conflict of interest. 
&lt;br/&gt;
&lt;br/&gt;In the name of community interest, an independent non-commercial, non-profit tribe has now been turned into a tribe serving a private, commercial, for-profit business. The transformation was handled and sanctioned by tribe.net staff who also used the term community interest, when in fact tribe.net in itself is a for-profit business, and 1700+ members is advertisement money, folks.&lt;/div&gt;

    <summary type="html">&lt;div&gt;Hi all. I just joined the tribe today, and I wanted to ask opinions from other tribe moderators on something:
&lt;br/&gt;
&lt;br/&gt;Some of the content on the tribe I moderate (needle play in bdsm) would be considered more mature than many other tribes, so the tribe is set as a private one.  The members are allowed to invite new members, but each one is reviewed to make sure that they have a complete profile.
&lt;br/&gt;
&lt;br/&gt;I am curious, with the new stance tribe has on content, how others are handling this issue of private vs public and controlling who may enter to lessen the risk of issues with someone who is not friendly to the topic of your tribe trying to cause it grief.

&lt;br/&gt;I'm the moderator of one of the largest kinky tribes here on tribe.net. I've just experienced something really odd and painful that I would like to share with you. Because, if it can happen to me, and the people guilty of breaking the tribe rules go free - it could happen to you too.
&lt;br/&gt;
&lt;br/&gt;Don't let that happen. This is about our rights as moderators, and I'm asking for your understanding and support.

&lt;br/&gt;First, let's me present the tribe members mentioned in this letter:
&lt;br/&gt;
&lt;br/&gt;* "sfsissysub" = that's me, the founder and moderator of "SF The Citadel" tribe
&lt;br/&gt;
&lt;br/&gt;* "Phil_of_the Citadel" = Phil. member of the tribe, and co-club owner of The Citadel
&lt;br/&gt;
&lt;br/&gt;* "Dungeon Vixen SF Citadel" = August, member of the tribe, and co-club owner of The Citadel
&lt;br/&gt;
&lt;br/&gt;* "Shatter" = member involved in flame war, expelled from my tribe for breaking my tribe rules and continuing the fight
&lt;br/&gt;
&lt;br/&gt;* "Patti B" = Patti Beadles, responsible for "Quality Assurance" at tribe.net and member of "SF The Citadel" tribe
&lt;br/&gt;
&lt;br/&gt;* "Jenni S" = Jennifer Snyder, Database Administrator at tribe.net

&lt;br/&gt;The Rights of a Moderator
&lt;br/&gt;
&lt;br/&gt;
&lt;br/&gt;In August 2004 I started "SF The Citadel" tribe. 
&lt;br/&gt;
&lt;br/&gt;In the description of the tribe I made it very clear that this was a grassroots initiative by an individual, me, and that this tribe was for people who played (safe, sane &amp;amp; consensual bdsm) at club "The Citadel" - but that the tribe was not
&lt;br/&gt;controlled by or directly affiliated with the club owners - just like tribes for rock bands here at tribe are not controlled by the rock band, its manager or record company. 
&lt;br/&gt;
&lt;br/&gt;During the first couple of days of its existence, I had a verbal discussion with Phil, one of the owners of club "The Citadel". He expressed some concerns that the tribe could possibly mean some negative publicity for the club. I told him that my intentions were all good and that I believe the tribe could have a positive effect, bringing more people to the club. I also told Phil that I was not willing to submit the tribe to some kind of control by the club owners, that I valued the tribes independence very high - but that I would be prepared to shut down the tribe if they didn't want it, at that time. 
&lt;br/&gt;He declined my offer to close the tribe.
&lt;br/&gt;
&lt;br/&gt;Next time we talked about the tribe it had a couple of hundred members and very positive activity. Phil at that time, and many times after that, expressed how grateful he and the other club owners were for the tribe I had created, and the great work I did to manage it.
&lt;br/&gt;
&lt;br/&gt;The tribe reached a membership of 1700+ members by early 2006, largely because of my work with direct invitations to individuals.
&lt;br/&gt;
&lt;br/&gt;After several months of internal fighting between a group of member who have close ties with the club owners and another individual, the tribe reached a crisis a couple of days ago, when this small group of members argued the same arguments over and over, and in many cases used a flaming language, with insults and angry outbursts.
&lt;br/&gt;
&lt;br/&gt;After a large number of attempts from my side, as the founder/moderator, to stop the fighting and get back to normal, I finally declared in a statement to all members that the fighting has to stop, and STOP NOW!
&lt;br/&gt;
&lt;br/&gt;I made clear that any member who continues to argue the conflict in the tribe, will be expelled. I stood by my words, and by Wednesday afternoon, March 15 2006, five of the members involved in the fighting had been expelled from the tribe - all of them for continuing to argue the conflict after I drew a line in the sand.  
&lt;br/&gt;
&lt;br/&gt;The five expelled members were close friends of the club owners, Phil &amp;amp; August. During Wednesday I received several tribe messages from one of the owners, August. She told me that she supported these members right to continue to argue the conflict, and she asked me to reconsider, and bring them back as members.
&lt;br/&gt;
&lt;br/&gt;I told her that if these members are not prepared to follow the tribe rules and stay away from fighting, they should not be members of this tribe.
&lt;br/&gt;
&lt;br/&gt;By late afternoon, 3/15, I got a new tribe message from August, where she told me that Shatter, the member who was first expelled (involved in flaming several times during the conflict), had started a new "Official Citadel" tribe. She had got an offer to moderate the new tribe, and she wrote to me that she had accepted.
&lt;br/&gt;
&lt;br/&gt;This is from the mission statement for the new "Official Citadel" tribe:
&lt;br/&gt;
&lt;br/&gt;"This will stand as the official Citadel tribe for all things related to The Citadel in San Francisco. Due to recent event it's been deemed need that an official tribe be started as the current SF Citadel Tribe is not representative of The Citadel in the least, with the Owners of the Citadel not allowed to voice any opinion contrary to the Nazi in control."
&lt;br/&gt;
&lt;br/&gt;The "Nazi in control" is supposedly me - a person who is as far from being a "Nazi" as anybody can be.  I've just done my best to handle my tribe to the best of my ability as a neutral moderator. 
&lt;br/&gt;
&lt;br/&gt;Regarding the statement  that the "the Owners of the Citadel (were) not allowed to voice any opinion" - is a fabrication of false information, and there's not a single post, tribe message or email supporting it.
&lt;br/&gt;
&lt;br/&gt;On the contrary, I've always welcomed the views of the club owners, as well as the views of any tribe member. I've treated the club owners with respect, and in a friendly manner. (see more than 18 months of my posts in "SF The Citadel" tribe)
&lt;br/&gt;
&lt;br/&gt;When I found out about the new "Official Citadel" tribe, I informed my tribe members about the new tribe, and I wrote that I would decide the future of my tribe shortly, and let them know.
&lt;br/&gt;
&lt;br/&gt;During this whole period of fighting I had been looking for guidelines in tribe.net's FAQs. In the FAQ it was clearly written that I, as the moderator of a tribe, have the right to expel members, and also to close and delete the
&lt;br/&gt;tribe that I have created and moderated.
&lt;br/&gt;
&lt;br/&gt;Tired of all the internal fighting, and personal attacks &amp;amp; insults on me as the moderator, I decided to close the tribe.
&lt;br/&gt;
&lt;br/&gt;I posted an announcement in the tribe and in a few related tribes, announcing my plans to shut down "SF The Citadel" tribe I created, stating my reasons and informing the members that the new "Official Citadel" tribe would take its place..
&lt;br/&gt;
&lt;br/&gt;First, I did as advised in tribe's FAQ section "How do I delete a tribe I've created?". I sent an email to &amp;amp;lt;help@tribe.net&gt; with with the words "remove SF The Citadel tribe" in the subject line, asking for assistance in deleting this moderated tribe. I never heard back from the help line.
&lt;br/&gt;
&lt;br/&gt;Second, I started to delete photos, subject threads and members, as my way to shut down and delete the tribe. It was all deleted and gone around midnight 3/15-16.
&lt;br/&gt;
&lt;br/&gt;About 24 hours later all the data was recovered by Patti Beadles, responsible for "Quality Assurance" at tribe.net and member of "SF The Citadel" tribe. 
&lt;br/&gt;
&lt;br/&gt;Patti B" acted on a request from August, "Dungeon Vixen SF Citadel" at tribe, co-owner of The Citadel club. "Patti B" was according to her own posts assisted by "Jenni S", Database Administrator at tribe.net. 
&lt;br/&gt;
&lt;br/&gt;After Patti had recovered all deleted data, she offered the hijacked tribe as a gift to August. A new mission statement was written and the people who had been involved in the fighting, on the same side as those who were expelled, rejoiced and celebrated as expressed in their posts. The main opponent, Rapture, was expelled from the tribe, and so was I - the creator and moderator of the tribe. 
&lt;br/&gt;
&lt;br/&gt;As far as I understand, what Patti and Jenni at tribe.net did - on the request from another tribe member re-opening the tribe and recovering all its data - has no support in tribe's Terms Of Use and Frequently Asked Questions. 
&lt;br/&gt;
&lt;br/&gt;Instead, what is actually stated is that the Moderator has the right to delete the tribe he has created. See "How do I delete a tribe I've created?" in tribe's FAQ. 
&lt;br/&gt;
&lt;br/&gt;Also, this is what tribes Terms Of Use (TOU) says:
&lt;br/&gt;
&lt;br/&gt;"5. Content
&lt;br/&gt;We do not claim ownership of the content you post or otherwise provide to the Service. However, you hereby grant, and agree to grant as an effect of posting or otherwise providing content, the following license: to the public, a license for personal non-commercial use; and to Tribe, a perpetual license to use, copy, distribute, display, perform, and modify any and all content that you post on the Service. This license cannot be withdrawn except that any content deleted from the Tribe site will terminate the Tribe license. Your use of the service is in consideration for this license, we will not otherwise pay you for your content. You represent and warrant that you have not granted and will not grant any rights inconsistent with this license."
&lt;br/&gt;
&lt;br/&gt;So, "any content deleted from the Tribe site will terminate the Tribe license" (tribe.net's right) to use the material in any form. 
&lt;br/&gt;
&lt;br/&gt;Tribe staff, Patti &amp;amp; Jenni gave themselves the right to recover material I had deleted, in clear breach with the TOU. 
&lt;br/&gt;
&lt;br/&gt;How is this hijacking possible? How can tribe staff break their own rules and assist a group of members in a coup to take over a tribe I have created, and decided to delete? My tribe is still up there, but with me on the outside, a new mission statement, a new moderator (one of the club owners).
&lt;br/&gt;
&lt;br/&gt;I feel violated both as a tribe moderator and as a individual member of tribe.net. My character has been smeared and I've been robbed of my creation.

&lt;br/&gt;What will tribe.net do to correct the wrong doings against me and my tribe? &lt;/div&gt;

    <title>The responsibilities of a Moderator?</title>

&lt;br/&gt;
&lt;br/&gt;What is the responsibility of a moderator to the community that they have created?
&lt;br/&gt;
&lt;br/&gt;Are they obligated to police it?  Are they obligated to respect the wishes of the majority?  What should happen when the moderator's self-interest conflicts with that of the tribe as a whole?&lt;/div&gt;

    <summary type="html">&lt;div&gt;http://free-association.net is up, running, and ready for you to migrate your tribes into shiny, new ad- and censorship-free Associations. It's still a little rough around the edges—especially in the UI, for now—but is really starting to "get there".
&lt;br/&gt;
&lt;br/&gt;We have user-generated Associations with Image Galleries, both Owner and Moderator-cloass users, an easy way to appoint mods or change owners, and moderated and private Associations are on their way shortly.
&lt;br/&gt;
&lt;br/&gt;User profiles have all the good stuff you'd expect in a profile: the juicy (and non-juicy) info and vital stats, image galleries, blogs, Association lists, recent posts, friend connections (including the ability to see, up to 3 degrees out, how you connect to someone), etc.
&lt;br/&gt;
&lt;br/&gt;Private Messages and Friend Connection requests (and answers) are forwarded to email, as you'd expect.
